App Terms of Use (EULA)

This End User License Agreement ("EULA") is a legal agreement between you ("you" or "user") and AQR INNOVATIONS PRIVATE LIMITED (CIN: U63120KA2026PTC225863, GSTIN: 29ABGCA4237R1Z0), having its registered office at Unit No. 101, Oxford Towers, 139, HAL Old Airport Rd, Kodihalli, Bengaluru, Karnataka 560008("Tifio", "Licensor", "we", "us", or "our"), governing your download, installation, and use of the Tifio mobile application (the "App") on the Apple App Store and Google Play.

This EULA covers your use of the App itself. The underlying tiffin pickup and delivery service that the App lets you book is separately governed by our Terms & Conditions, and your personal data is governed by our Privacy Policy. By downloading, installing, or using the App, you agree to be bound by this EULA, our Terms & Conditions, and our Privacy Policy. If you do not agree, do not download, install, or use the App.

1. License Grant

Subject to your compliance with this EULA, Tifio grants you a limited, non-exclusive, non-transferable, revocable license to download and use the App, in object code form only, for your personal, non-commercial use:

• on any Apple-branded product that you own or control, and only as permitted by the Usage Rules set forth in the Apple Media Services Terms and Conditions / App Store Terms of Service; or
• on any Android-powered device that you own or control, and only as permitted by the Google Play Terms of Service.

You may not copy (except as expressly permitted by this license), decompile, reverse engineer, disassemble, attempt to derive the source code of, modify, or create derivative works of the App, any updates, or any part of it, except to the extent such restriction is prohibited by applicable law. You may not rent, lease, lend, sell, redistribute, or sublicense the App.

2. Your Account

To use most features of the App, you must register using your name, phone number, and email address, and provide your child's school and delivery details as described in our Privacy Policy. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately at hello@tifio.in of any unauthorized use of your account.

3. Acceptable Use

When using the App, you agree that you will not:

• provide false, inaccurate, or misleading information about yourself, your child, or your delivery address;
• use the App for any purpose other than booking and managing your own tiffin pickup and delivery service;
• interfere with, disrupt, or attempt to gain unauthorized access to the App, its servers, or any connected systems;
• use the App in any way that is abusive, threatening, or harmful towards our coordinators, staff, or other users; or
• use the App in violation of any applicable law, including the Information Technology Act, 2000, and rules made thereunder.

4. App Permissions and Data

The App may request permissions such as precise location (to confirm your pickup address and delivery route), camera access (to scan QR tags on tiffin boxes), and push notifications (to send delivery confirmations and order updates). You may decline or later revoke any permission through your device settings, though doing so may limit certain App features. Full details of what we collect and why are set out in our Privacy Policy.

5. Orders, Pricing, and Payments

The App is used to place real-world tiffin pickup and delivery orders under our Quick Order pricing (no subscription) — see our Terms & Conditions for current pricing, free trial, and referral terms. Payments for orders placed through the App are processed via third-party payment gateways (UPI, card, or net banking) and are not billed through Apple's or Google's in-app purchase systems, since they are charges for a real-world delivery service rather than digital content. Consequently, order payments, cancellations, and refunds are governed entirely by our Terms & Conditions and are not eligible for refund through the App Store or Google Play.

6. Maintenance and Support

Tifio, and not Apple or Google, is solely responsible for providing any maintenance and support services with respect to the App, as required under applicable law. Apple and Google have no obligation whatsoever to furnish any maintenance or support services for the App. For support, contact us at hello@tifio.in or via WhatsApp.

7. Warranty Disclaimer

The App is provided "AS IS" and "AS AVAILABLE", without warranty of any kind, to the maximum extent permitted by applicable law. In the event of any failure of the App to conform to any applicable warranty, you may notify Apple or Google, as applicable, and the purchase price for the App (if any) may be refunded to you; to the maximum extent permitted by applicable law, Apple and Google will have no other warranty obligation whatsoever with respect to the App, and any other claims, losses, liabilities, damages, costs, or expenses attributable to any failure to conform to any warranty will be Tifio's sole responsibility.

8. Product Claims and Liability

Tifio, not Apple or Google, is solely responsible for addressing any claims by you or any third party relating to the App or your use of it, including but not limited to: (a) product liability claims; (b) any claim that the App fails to conform to any applicable legal or regulatory requirement; and (c) claims arising under consumer protection, privacy, or similar legislation. Save as set out in our Terms & Conditions, Tifio's aggregate liability to you in connection with the App is limited to the amount, if any, paid by you for the affected order.

9. Intellectual Property

The App, including its design, logos, text, graphics, and underlying software, is owned by Tifio and protected by applicable intellectual property laws. Tifio, not Apple or Google, is solely responsible for the investigation, defense, settlement, and discharge of any claim that the App or your possession and use of it infringes a third party's intellectual property rights.

10. Legal and Export Compliance

You represent and warrant that you are not located in a country subject to a U.S. Government embargo or that has been designated by the U.S. Government as a "terrorist supporting" country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.

11. Third-Party Terms of Agreement

When using the App, you must comply with the terms of any applicable third-party agreement to which you are a party, such as your wireless data service agreement and the applicable app store's terms of service, so as not to be in breach of it.

12. Updates and Termination

We may release updates to the App from time to time to add features, fix issues, or reflect changes in our services; some updates may be required to continue using the App. We may suspend or terminate your access to the App, with notice where practicable, for breach of this EULA, non-payment for a placed order, or misuse of the App. You may stop using the App and delete it from your device at any time.

13. Third-Party Beneficiary

This EULA is between you and Tifio only, and not with Apple Inc. or Google LLC. Tifio, not Apple or Google, is solely responsible for the App and its content. Notwithstanding this, you acknowledge that Apple Inc. and its subsidiaries, and Google LLC and its subsidiaries, are third-party beneficiaries of this EULA, and that, upon your acceptance of this EULA, each of Apple and Google will have the right (and will be deemed to have accepted the right) to enforce this EULA against you as a third-party beneficiary of it.

14. Grievance Redressal

In accordance with the Information Technology Act, 2000 and rules made thereunder, complaints regarding the App may be addressed to our Grievance Officer:

The Grievance Officer will acknowledge your complaint and work to resolve it within 15 days of receipt of the complaint.

15. Governing Law and Jurisdiction

This EULA is governed by the laws of India. Subject to the grievance redressal process above, the courts and consumer forums at Bengaluru, Karnataka shall have exclusive jurisdiction over any dispute arising out of or in connection with this EULA, without prejudice to any additional forum available to you as a consumer under the Consumer Protection Act, 2019.

16. Amendments

We may revise this EULA from time to time to reflect changes in the App, our operations, or applicable law, including updates required by Apple or Google's respective app store policies. We will notify you of material changes via the App, WhatsApp, email, or a notice on our website before they take effect. Continued use of the App after such notice constitutes acceptance of the revised EULA.
